General Terms and Conditions (GTC)
1 Scope of application
1.1 These General Terms and Conditions (GTC) apply to all contracts, deliveries and other services of michel.salzmann.photography (hereinafter referred to as ‘Provider’).
1.2 Deviating terms and conditions of the customer are not recognised unless the provider expressly agrees to their validity in writing.
2 Conclusion of the contract
2.1 The presentation of products and services on the website or in other media does not constitute a legally binding offer, but an invitation to place an order.
2.2 By placing an order, the customer submits a binding offer. The contract is concluded as soon as the provider confirms the order in writing or by e-mail.
3 Prices and terms of payment
3.1 All prices are quoted in Swiss francs (CHF) and include VAT.
3.2 Payment shall be made in advance, by credit card, PayPal or TWINT. The Provider reserves the right to invoice the agreed services. The provider reserves the right to exclude certain payment methods in individual cases.
3.3 The payment deadline can be found on the invoice issued. The costs for physical invoicing shall be borne by the customer.
3.4 If the customer is in default of payment, the provider is entitled to charge interest on arrears at a rate of 5% per annum.
4 Delivery and dispatch
4.1 Delivery shall be made either digitally or physically, at the customer's discretion.
4.2 Digital products are delivered by providing a download link or by e-mail.
4.3 Physical products are delivered to the address specified by the customer. The customer shall bear the costs of despatch.
4.4 Delivery dates are only binding if they have been expressly agreed in writing.
5 Retention of title
5.1 The delivered products remain the property of the provider until full payment has been received.
6. right of cancellation
6.1 The customer has the right to withdraw from the contract within 14 days without giving reasons.
6.2 The cancellation period is 14 days from the day on which the customer or a third party nominated by him has taken possession of the goods.
6.3 In order to exercise the right of cancellation, the customer must inform the supplier of his decision to cancel this contract by means of a clear declaration (e.g. a letter sent by post or e-mail).
6.4 The right of cancellation does not apply to custom-made products and services that have been specially manufactured according to the customer's wishes.
7 Warranty and liability
7.1 The statutory warranty rights apply.
7.2 The provider is only liable for damages caused by wilful or grossly negligent breaches of contract.
7.3 Liability for slight negligence is excluded.
8 Copyrights and rights of use
8.1 All copyrights and other rights to the delivered products shall remain with the Provider.
8.2 The customer receives a simple, non-transferable right to use the digital and physical products for personal use.
8.3 For the use of photos in the context of services, e.g. for travel companies, the customer receives a right of use limited to the purpose of the contract.
9. services in the field of landscape photography
9.1 The Provider offers services in the field of landscape photography for travel companies. The exact scope of the services is set out in the respective contract.
9.2 The Customer shall ensure that all authorisations and access required for the provision of the service are available.
9.3 The provider is not liable for delays or cancellations caused by circumstances for which it is not responsible (e.g. weather conditions).
10 Data protection
10.1 The Provider shall process the Customer's personal data only for the purpose of order processing and in compliance with the applicable data protection regulations.
10.2 Data shall only be passed on to third parties if this is necessary for the fulfilment of the contract.
